Key Takeaways from CMS’ “Go Paperless” Webinar

Yesterday, on April 13, 2022, the Centers for Medicare and Medicaid Services (CMS) hosted a Medicare Secondary Payer Recovery Portal (MSPRP) Go Paperless Webinar.

As you may recall from one of our prior blogs, CMS hosted this webinar to provide the Medicare Secondary Payer (MSP) community with additional details regarding a Responsible Reporting Entity’s (RRE) or its Recovery Agent’s ability to receive all of Medicare’s recovery correspondence digitally via the MSPRP. Here are some of the key takeaways from yesterday’s webinar:

-RREs may only opt-in to the “Go Paperless” functionality via the Section 111 reporting process

-This may be accomplished through either A) Section 111 COBSW, or B) TIN Reference File Submission

-It is only necessary to opt-in via Option A or B above; however, CMS specifically recommended opting-in via both methods

-Once successfully opted-in, the MSPRP Account Manager (AM) and Account Designees (ADs) will be notified via e-mail when new correspondence is posted to the MSPRP

-CMS will not implement a “grace” or “testing” period. Therefore, if an RRE or its Recovery Agent opts-in and fails to timely respond to Medicare’s recovery correspondence, the RRE will remain responsible

-Note – while not explicitly stated, CMS (and its recovery contractors) may conceivably grant an RRE a “good cause” exemption for a missed administrative appeal deadline if the RRE is familiarizing itself with the Go Paperless feature for the first time

-Once the AM and ADs receive an e-mail notification that new correspondence has been posted to the MSPRP, such correspondence will only be available for download for thirty (30) days

-The e-mail notification will be delivered from mspcenter@cms.hhs.gov. Given that RREs will remain responsible for reviewing and acting upon such correspondence, RREs (or their recovery agents) should ensure that the e-mail notifications are not automatically routed to spam or junk folders

Commentary: CMS clearly indicated that the Go Paperless functionality is currently only available to RREs and their Recovery Agents. This functionality is not currently available to Medicare beneficiaries and non-Recovery Agent attorneys who do not have access to the MSPRP.
