CMS to Host Second Medicare Secondary Payer & Civil Money Penalties Webinar on Oct 17, 2024

On September 24, 2024, the Centers for Medicare & Medicaid Services (CMS) published a notice confirming an upcoming webinar regarding Civil Money Penalties (CMP) and Mandatory Reporting for Liability Insurance (including Self-Insurance), No-Fault Insurance, and Workers’ Compensation.

The notice provides the following description and details:

CMS will be hosting a webinar regarding Certain Civil Money Penalties for NGHP Responsible Reporting Entities (RREs). The format will be opening remarks and a presentation by CMS that will include reminders about the Final Rule, the auditing process, and important dates, followed by a question and answer session.

Earlier that same day, the CMS announced that a new S111 Non-Group Health Plan (NGHP) Civil Money Penalties (CMP) webpage is now available. This site covers the expansive CMP process for NGHP S111 Reporting including how to identify non-compliance, calculating penalty amounts, and methods of communication. Furthermore, the daily maximum CMP amount recently increased from $1,428.00 to $1,474.00 per the Annual Civil Monetary Penalties Inflation Adjustment ( 45 C.F.R. § 102.3).

CMS’ Final Rule for imposing civil money penalties against non-compliant Responsible Reporting Entities (RREs) becomes applicable on October 11, 2024, and will be enforced as of October 11, 2025. In light of these fast-approaching developments, CMS’ upcoming webinar sets the stage for those in the industry to hone last-minute inquiries.
